Justice SK Singh will remain head of TDSAT: Supreme Court | India News


NEW DELHI: As the selection panel headed by the Chief Justice of India or his appointed SC judge could not find a successor, the Supreme Court on Thursday ordered the continuation of retired SC Justice Shiva Kirti Singh as President of the Telecom Court of Appeal and Dispute Resolution (TDSAT).
Judge Singh was appointed Chairman of TDSAT on April 21, 2017 and under the Telecommunications Regulatory Authority of India (Trai) Act, is a three-year term. This means that Judge Singh should have resigned on April 20 of last year.
However, due to large vacancies in membership positions and to avoid the possibility of the apex telecommunications appeal court closing for litigants, the CS has been periodically extending Judge Singh’s term.
The last such extension was granted on January 4. The TDSAT president is selected by a panel headed by the CJI or its nominee. Although Judge Singh’s successor should have been selected by the panel well before April 20 of last year for a smooth transition, the panel has been unable to do so for various reasons.
