Choksi disappeared in Antigua last week amid speculation that he may have fled to Cuba.
After this, the Antigua government sent notices to different counties seeking his whereabouts. Interpol was also asked to issue a Yellow Notice.
Sources said Choksi may have been detained Tuesday night in Dominica following the Interpol alert.
Following his capture, the Prime Minister of Antigua and Barbuda, Gaston Browne, had said that he would be extradited to India. But the court order now puts a question mark on the process.
Choksi, 63, is involved in the Rs 12,000 crore GNP scam and is wanted in India on charges of fraud.
India is also pushing for the extradition of Nirav Modi, another defendant in the same case, who is currently in a UK jail.
