NEW DELHI: A PIL seeking instructions from the Electoral Commission to annul the results of the elections and conduct new votes if the maximum number of votes in favor of NOTE has been obtained in a particular constituency has appeared in the Supreme Court.
The guilty plea filed by BJP leader and defender Ashwini Kumar Upadhyay has also sought instructions to restrict the participation of contending candidates in the new elections, who have participated in the annulled elections.
“The Court may declare that if ‘none of the above’ (NOTE) obtains the maximum number of votes, then the election for that electoral district will be annulled and a new election will be held within six months; and the contending candidates rejected in the annulled elections, they shall not be allowed to participate in the new elections, “said the statement delivered through lawyer Ashwani Kumar Dubey.
The petition argued that political parties elect competing candidates in a highly undemocratic manner without consulting the voters, so many times people in the constituency are totally unhappy with the candidates that are presented to them.
“This problem can be solved with a new election if the maximum number of votes in favor of NOTE is obtained. In such a situation, the contending candidates should be considered rejected and will not be allowed to participate in the new election.”
“The right to reject and elect a new candidate will empower people to express their discontent. If voters are not satisfied with the background of the candidate in dispute, they will choose to NOTE to reject said candidate and elect a new candidate,” he said the declaration.
The statement said that the percentage of candidates with a criminal record and their chances of winning has actually risen steadily over the years.
“The damage caused to the public is extremely great and continues to this day, as the right to reject is an integral part of Article 19, but the Center and the ECI did nothing to declare the election result invalid and hold new elections. if the maximum number of votes in favor of NOTE is counted, “he added.
