NIA rejects reports of Stan Swamy’s sip seizure as ‘fake and mischievous’

The 83-year-old man was arrested at his Ranchi residence on October 8 for his alleged involvement in the Elgar Parishad case and is being held at Taloja Jail in Mumbai.
A spokesman for the National Investigative Agency (NIA) said Swamy is a staunch activist for the outlawed CPI (Maoist) and was indicted on October 9 along with seven other defendants for his involvement in the Bhima Koregaon Elgar Parishad case.
The case relates to an Elgar Parishad event on December 31, 2017 organized in Shaniwarwada in Pune, where alleged provocative speeches were made, leading to violence resulting in loss of life and property and statewide upheaval in Maharashtra.
The NIA never took his police custody, and all the necessary legal formalities such as his medical examination were duly complied with, the spokesperson said, adding that he has been in judicial custody since then at the Taloja Central Jail.
Almost a month later, on November 6, Swamy filed an application in the NIA court in Mumbai to retrieve his straw and sip, which he falsely claimed that the NIA had stayed, the official said.
The court asked the NIA to present its response on the next date on November 26.
The NIA duly filed its response in court on the scheduled date, stating that it had conducted its personal search in the presence of independent witnesses and no such straw and straw was found, the spokesperson said.
The court later rejected Swamy’s request and issued the necessary instructions to the jail authorities on November 26 to provide him with straw and sips.
As the defendant was in judicial custody, the matter was between him and the prison authorities, which are under the Maharashtra state administration, the NIA official said.
“The reports claiming that the NIA recovered the straw and sip from the defendant Swamy and requested a deadline of 20 days from the court to respond to his request to allow him a handjob and a sip in the central jail of Taloja are false, incorrect and mischievous Since the NIA did not recover a straw or a sip from the defendant, nor did it request a period of 20 days to present a response to said request, ”added the official.
According to the NIA, Swamy was spreading among other cadres that the arrest of CPI (Maoist) urban cadres from different parts of the country, particularly in Maharashtra, has caused irrevocable damage to the outlawed organization.
He has alleged that he received funds from other Maoist cadres to promote the activities of the PCI (Maoist).
Swamy is the convener of the Persecuted Prisoners Solidarity Committee (PPSC), a front-line organization of the PCI (Maoist), the official said.
The incriminating documents related to communications to promote the activities of the (Maoist) CPI were confiscated from his possession, the NIA official added.
The Bhima Koregaon case was taken up by the NIA on January 24 of this year. The Pune Police have alleged that the violence was caused by speeches made by members of the Elgar Parishad group a day earlier.
