‘No Criminal Record’: Court Will Hear Bail Petitions From Bharti Singh, Harsh Today

A Mumbai court will hear bail requests from comedian Bharti Singh and her husband Harsh Limbachiya on Monday, one day after the duo were sent to court until December 4 in drug-related cases.

Bharti Singh was arrested on Saturday after the Office of Narcotics Control recovered 86.5 g of marijuana from the Andheri home of Bharti and Harsh. Up to 1000 g of marijuana is considered a small quantity, for possession of which one can be imprisoned for up to six months and / or a fine of Rs 10,000 may be imposed.

NCB has said that both Bharti and Harsh have admitted to using ganja. After Harsh was arrested on Sunday, the couple were brought before a magistrates court on Sunday that sent them into judicial custody. Shortly after the court order, the couple submitted a request for bail through attorney Ayaz Khan. In their bail statements, Singh and Limbachiya sought to be released saying they have no criminal record and therefore there is no question that they are on the run.

During the hearing, the NCB requested custody of Limbachiya for questioning, but did not request custody of Singh and told the court that she could be sent to judicial custody. His lawyer Khan argued that this is not an interrogation in custody as the alleged substance recovered is less than the “small amount” prescribed by the Narcotics and Psychotropic Substances Act (NDPS).

The magistrate accepted the arguments and noted that no custody questioning was required and that the defendants have already been questioned for a considerable time on Saturday.

Singh and Limbachiyaa have been registered under sections 20 (b) (ii) (A) (involves a small amount of drugs) and 8 (c) (drug possession) and 27 (drug use) of the NDPS Act.

Acting as a tip off, the NCB conducted a search of Singh’s office and residence on Saturday after a drug dealer revealed Singh’s name. This is part of NCB’s ongoing investigation into alleged drug use in Bollywood, an issue that came to the fore after the death of Sushant Singh Rajput on June 14.

Bharti Singh has appeared on various comedy and reality TV shows and also hosted some of those shows. Harsh is a screenwriter and lyricist.
