NEW DELHI: Supreme Court on Tuesday rejected vigorous attempts by two PIL petitioners to get former DGP KL Gupta, member of Justice Commission BS Chauhan, to investigate the murder of eight police officers and the subsequent murders of gangster Vikas Dubey and its four associates, replaced.
Two PIL advocates, Ghanshyam Upadhyay and Anoop Prakash Awasthi, read parts of Gupta’s interview to various media organizations that allegedly sided with the police action immediately after the July 10 meeting on the Dubey assassination while he was carrying Special Task Force personnel. from Ujjain to Kanpur.
They said that the bias that emerged from Gupta’s alleged statements, which blatantly justified police action, would influence the commission’s work and take away public confidence. But Attorney General Tushar Mehta, who appeared for the UP government, told the court that it was regrettable that the petitioners chose to project only half of the image before the court, citing select portions of their interview.
The bank, which was initially skeptical of the former DGP’s statement as read by the petitioners, was not happy with the two defenders for presenting a unilateral image in court. After the SG showed the transcript of the full interview to the court, the CJI said: “What is not correct about Gupta? He has also said that the culprit will be punished after an investigation. Man has taken a balanced view. Additionally, there is a former Supreme Court judge and a former Superior Court judge on the commission. How can the commission’s conclusions be vitiated?
