Supreme Court: Grant permanent commission in the Army to women officers who opt for it | India News

NEW DELHI: In a verdict that demolished gender discrimination in the Army, the Supreme Court ruled on Monday that all female officers will be considered for a permanent commission and will also be eligible for the command post on par with male officers.
A bank of judges D Y Chandrachud and Ajay Rastogi granted the Center three months to implement their order and criticized the Center for denying equal opportunities to official women in raising social norms, physiological limitations and family obligations associated with women.
The bank said that official women should also receive a permanent commission in the Army and that a change of mentality is required in part of the government end gender discrimination in the armed forces.
The SC said that the Center’s arguments that raise the issue of physiological limitations and social norms to deny the opportunity to official women are disturbing and cannot be accepted since official women have had exceptional performance and brought laurels.
He said the Center showed little respect for the order approved by the superior court of Delhi and the Supreme Court of the permanent commission to women in the last decade after the HC approved the order in 2010.
The superior court said that the absolute prohibition of granting the command of command to women officers in the Army is irrational and against equality. He said it is indefensible to deny sending commands to official women and that a general prohibition cannot be upheld by law.
The SC also added: “Women do not have weaker sexual relations and should be treated alongside army officers in non-combat services.”
