New Delhi, July 22 (): Reliance Chairperson Anil Dhirubhai Ambani and his wife Tina have moved the Supreme Court today challenging the order of a 2G trial court hearing the 2G spectrum allocation scam asking them to appear as prosecution witnesses.
The court will hear the matter on Wednesday. On Friday, the special court hearing the 2G case was told by the CBI that it needed to question the husband and wife along with 11 others. The reason given was that the investment of Rs 900 crore in Swan Telecom and its promoters Vinod Goenka and Shahid Usman Balwa who are accused in the scam by Reliance ADA Group needs to be questioned.
CBI also wanted 11 others connected with this investment to be summoned. OP Saini, the special judge of CBI accepted the plea.
In 2011, Anil Ambani had been questioned but it was before the plea was filed by the CBI. From July 22 (today), all the witnesses will start to testify in the case but the date when Anil will testify is yet to be fixed. CBI told the court that if there was clarity in Anil Ambani’s statement,then one need not question Tina.
Anil Ambani would have to answer as to why he incorporated the alleged shell companies, even though he may not have been a part of the decision making but would have been in know about these matters.
Since husband and wife had full powers to issue cheques for the Reliance ADAG, they were summoned. Defense lawyers for Hari Nair (Senior VP) Surendra Pipara (Group President) and Group MD Gautam Doshi said that the CBI move was to only delay the case and asked for an explanation. The court reserved the order on the summons.
Reliance ADAG counsel told Supreme Court that the trial in the lower court was in the final stage and summoning Anil and Tina was not needed and asked the CJI to give an early hearing and the court agreed.
