Chennai/ Madurai, Dec 13 (): The Madras High Court bench, comprising Justices K N Basha and M Venugopal hearing petitioner R V S Vijayakumar, state President of PWD Senior Engineers Association issued notice after having recorded the submission of Special Government Pleader G Mahendran that protection would be given to PWD officials,family members and Ayyappa devotees till the Tamil Nadu border ordered notice to Chief Secretaries of Tamil Nadu and Kerala besides other top officials.
Vijayakumar citing Intelligence Bureau reports said that after the water level at Mullai Periyar dam was reduced from 152 feet to 136 feet, 3,914 acres had fallen vacant on which buildings had been raised without state government’s consent. No objection certificate had not been obtained from the forest ministry. These illegal encroachments around the dam should be removed.
A political group from Kerala had damaged a gate of the dam and in view of this, IB had also recommended that Central Industrial Security Force or Central Reserve Police force be deployed and also trained fire service personnel should immediately be deployed at the site.
The bench also ordered notice to Union secretaries of Home, Environment and Forests and Water Resources, DGP Kerala, Home Sof the states, Chief Engineer of Water resources, Tamil Nadu, Theni district Superintendent of Police and Theni Collector.The Additional Solicitor General took notice for the Union secretaries of Home, Environment and Forests and Water Resources.
A five-judge Constitution bench of the Supreme Court comprising of Justices D K Jain, R M Lodha, Deepak Verma, C K Prasad and A R Dave will today meet at 3.30 pm to examine the cross applications moved by Tamil Nadu and Kerala seeking the apex courts’ intervention on the fresh row relating to the controversial Mullai Periyar dam.
The application moved by DMK on Monday may also figure in the case today.
